Drug testing by employers in Hawaii is governed by these state rules.
An employer may not require, request, or suggest that any individual submit to a substance abuse test that does not meet all the requirements of Hawaii's drug testing law, except for employers who are covered by any drug testing regulation promulgated by the Hawaii Department of Transportation or the U.S. Department of Transportation or any other federal agencies.
All costs, including confirmatory testing costs, are to be paid for by the employer.
Failure to adopt or adhere to all the procedures required by Hawaii's drug testing law invalidates the test results, and the test results may not be reported or otherwise used for any purpose. The procedures required vary depending on the type of test and where it is administered.
