Workplace Smoking Rules in Nevada

Employers in Nevada must comply with these state rules regulating smoking in the workplace.

The Nevada Clean Indoor Air Act prohibits smoking within indoor places of employment, with certain exceptions.

Employers covered: Employers with one or more employees.

Written policy requirements: Employer policy not specified.

Posting requirements: "No Smoking" signs or the international "No Smoking" symbol must be clearly and conspicuously posted in every public place and place of employment, including entrances, where smoking is prohibited

Ashtrays and smoking paraphernalia must be removed from any area where smoking is prohibited.

No smoking areas: In Nevada, smoking is prohibited within indoor places of employment, including;

• child care facilities
• movie theaters
• video arcades
• malls and retail establishments
• all areas of grocery stores
• all indoor areas within restaurants
• government buildings and public places
• within school buildings and on school property

Permitted smoking areas. Smoking is not prohibited under the Nevada Clean Indoor Air Act in the following

• private residences, including when used as a workplace, except when used as a child care, adult day care or health care facility
• stand-alone bars, taverns and saloons
• strip clubs or brothels
• retail tobacco stores
• areas within casinos where loitering by minors is prohibited by state law
• convention facilities during certain tobacco and convenience store meetings and trade shows

An owner is not prohibited from voluntarily creating nonsmoking sections or from designating an entire establishment as smoke-free.
