New Mexico Nursing in the Workplace Rules

New Mexico employers must comply with these state rules regarding nursing in the workplace.

Employers must allow nursing mothers to breastfeed a child in all public and private places where the mother is otherwise allowed to be present.

Employers are required to provide flexible break times, but are not liable for storage or refrigeration of breast milk or payment for a nursing mother's break time in addition to established employee breaks.

Employers are required to provide nursing mothers with a space for using a breast pump that is clean and private, near the employee's workspace, and not a bathroom.
