Tipped Employees in New Mexico

Employers in New Mexico must conform with these state rules regarding the treatment of tips received by employees.

Employees in New Mexico who regularly receive more than $30 a month in tips must be paid a minimum hourly rate of $2.13.

Employers may consider tips as part of wages, but the tips combined with the employer's cash wage cannot be less than the state minimum wage per hour.

Tip pooling is permitted.
