Oklahoma employers must provide employees with leave for military duty in accordance with these state rules.
Employers are required to grant leave to eligible employees ordered to active or inactive duty or service, without loss of status or seniority.
Employers must grant leave to employees who are members of the National Guard required to assemble for drill and instructions at least 48 times each year and to participate in encampments, maneuvers, or other exercises at least 15 days in training each year.
Employers may elect to pay eligible employees an amount equal to the difference between their full regular pay in the private sector and their military pay.
Employers must reinstate former employees, upon the expiration of their period of active duty in the military service, without loss of status or seniority.
Employers cannot discharge an employee because the employee is an officer, warrant officer, or enlisted person in the military forces of the state.
