Workplace Smoking Rules in Oregon

Employers in Oregon must comply with these state rules regulating smoking in the workplace.

In Oregon smoking is prohibited in places of employment, except for designated areas. Employers must provide a place of employment that is free of tobacco smoke for all employees.

Employers covered: Employers with one or more employees.

Posting requirements: Employers must post signs that provide notice of the no smoking provisions, except in areas where smoking is permitted by law.

No smoking areas: A person may not smoke or carry any lighted smoking instrument in a public place or place of employment except in areas designated as smoking areas by law. The prohibited areas include entrances, exits, windows that open, and ventilation intakes that serve an enclosed area.

Permitted smoking areas: Smoking is permitted in the following areas:

• the owner or person in charge of a hotel or motel may designate up to 25 percent of the sleeping rooms of the hotel or motel as rooms in which smoking is permitted
• smoking of noncommercial tobacco products for ceremonial purposes is permitted in spaces designated for traditional ceremonies in accordance with the American Indian Religious Freedom Act
• smoking is permitted in a smoke shop and in a cigar bar if that cigar bar generated on-site retail sales of cigars of at least $5,000 for the calendar year ending December 31, 2006, as well as meeting other requirements
• certain stand-alone smoke shops
