Military Duty Leave for Employees in Rhode Island

Rhode Island employers must provide employees with leave for military duty in accordance with these state rules.

Employees in Rhode Island who enter or are active members of the U.S. military forces are entitled to military leave privileges.

Military leave for National Guard members is unpaid, and military leave for reserve force members may be with or without pay, at the employer's discretion.

Reinstatement

Employees in Rhode Island on military leave are entitled to reinstatement to their former employment or position of seniority, status and pay if qualified to perform the duties of the position, unless the employer's circumstances have so changed as to make it impossible or unreasonable to do so.

Family Military Leave

Employers that employ between 15 and 50 employees must provide up to 15 days of unpaid family military leave to an employee who is the spouse or the parent of a service person during the time federal or state orders are in effect.

Employers with 50 or more employees are required to provide up to 30 days of unpaid family military leave to an employee during the time federal or state orders are in effect.
