South Dakota Minimum Wage Law

Employers in South Dakota must conform with these state rules regarding the minimum wage paid to employees.

In accordance with the federal minimum wage rate, the South Dakota minimum wage is $7.25 per hour.

Employees are covered by South Dakota's minimum wage law with the exception of:

• persons under age 20 who are paid an opportunity wage
• babysitters
• outside salespersons

Effective March 17, 2011, the minimum wage provisions do not apply to certain seasonal workers employed by an amusement or recreational establishment, an organized camp, or a religious or nonprofit educational conference center if the establishment, camp, or center:

• does not operate for more than seven months in any calendar year; or
• during the preceding calendar year, the average receipts of the establishment, camp, or center for any six months of the calendar year were not more than thirty-three and one-third percent of its average receipts for the other six months of the year.
