Virginia employers must comply with these state rules regarding nursing in the workplace.
A mother may not be prohibited from breastfeeding her child at any location where that woman is otherwise allowed to be, on property owned, leased or controlled by the state.
Employers are encouraged to provide reasonable unpaid break time each day to employees who need to breastfeed or express milk for their infant children. The break time may run concurrently with break time already provided.
Employers are also encouraged to make reasonable efforts to provide a room or other location close to the work area other than a toilet stall, where the employee can breastfeed or express milk in privacy.
Break time for breastfeeding and expressing milk is encouraged, but not if the activities unduly disrupt the operations of the employer.
