Meal and Break Rules in West Virginia

Employers in West Virginia must comply with these state rules relating to meals and break times.

Employers in West Virginia must provide meal breaks for employees who work six or more hours in a workday. The break must be at least 20 minutes long and must be scheduled at reasonable times designated by the employer.

Meal breaks must be provided for all employees who are not afforded necessary breaks and/or not permitted to eat a meal while working.
