Criminal Record Check Laws by State

State laws may restrict an employer's right to check the criminal records of job applicants and employees. However, for some occupations employers are required by law to conduct various criminal background checks.

In some states, employers have the right to conduct criminal background checks, although conditions may be imposed. Conditions imposed can include giving notice to an applicant and/or obtaining the applicant's written permission for the check. Some states have laws restricting criminal record checks to specific occupations or circumstances.
